1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts, orders, reservations, and other services between Chefs Warehouse Canteen & Bar and its guests. Any differing terms and conditions of the guests do not apply unless the restaurant expressly agrees to them in writing.

2. Opening Hours and Reservations

  • 2.1 The restaurant's opening hours are posted and published on the website.

  • 2.2 Reservations can be made by telephone, online, or in person. A reservation only becomes binding upon confirmation by the restaurant.

  • 2.3 The restaurant reserves the right to refuse reservations without giving reasons.

  • 2.4 In the event of delays of more than 15 minutes without prior notification, the restaurant reserves the right to reassign the table.

3. Conclusion of Contract and Service

  • 3.1 By ordering food and beverages, the guest submits a binding offer to conclude a service contract.

  • 3.2 The contract is accepted upon confirmation of the order by the service staff.

  • 3.3 Consuming food and beverages brought from outside (corkage fee applies) is only permitted with the express consent of the restaurant.

4. Prices and Payment

  • 4.1 All prices are in euros and include applicable VAT.

  • 4.2 Current prices can be found on the food and beverage menu. Prices are subject to change without notice.

  • 4.3 Payment is due immediately upon receipt of the invoice. Cash payments and cashless payment methods listed on the website or in the restaurant are accepted.

5. Group Reservations

  • 5.1 Separate terms and conditions apply to groups of 15 or more and private events. These will be agreed upon individually. The stated number of guests is binding until 72 hours prior to the event. Increases in the number of guests cannot be guaranteed and will incur additional charges.

  • 5.2 Upon conclusion of the contract, 80% of the total price is due as a deposit. The remaining balance is due 14 days after the event. For companies based abroad, 100% of the deposit is due. Additional services will be billed separately. If the minimum catering revenue is not reached, the difference will be charged as venue rental.

  • 5.3 The following cancellation fees apply in the event of cancellation:

    • Up to 90 days before the event: 30% of the total price

    • 89 to 60 days before the event: 50% of the total price

    • 59 to 30 days before the event: 80% of the total price

    • Less than 30 days before the event: 100% of the total price

  • 5.4 In the event of a no-show by the group or individuals, the full menu price will be charged.

  • 5.5 The client is liable for:

    • Damage to furnishings, equipment, or inventory caused by participants in the event.

    • The conduct of guests.

    • Loss of or damage to personal belongings.

    • The organizer is liable only for damages caused by gross negligence or willful misconduct on the part of its staff.

  • 5.6 In the event of circumstances beyond the control of either party, the organizer's obligation to perform is waived. Services already rendered by the organizer must be compensated.

  • 5.7 The applicable legal regulations regarding noise control and house rules must be observed. Violations may result in the organizer terminating the event.

  • 5.8 Amendments to this contract must be in writing. Should any provision of this contract be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  • 5.9 All prices are in euros and include the currently applicable statutory value-added tax.

6. Events

  • 6.1 These terms and conditions apply to participation in and the associated ticket sales for events organized by Chefs Warehouse canteen & bar GmbH (hereinafter referred to as "the organizer"). Any conflicting terms and conditions of the participant are invalid.
    The organizer reserves the right to amend or supplement these regulations. Any amendments or supplements will become effective upon publication on this website or on the event page www.chefswarehouse.de/events.

  • 6.2 Registration and Contract Conclusion

    • 6.2.1 Registration for participation in the event is only possible via the organizer's website or in person at the event venue via the box office.

    • 6.2.2 The organizer submits an offer to conclude a purchase agreement based on the information provided on the website. The participant accepts this offer by completing the order process and clicking the "Place order" button on the final order screen. Effective acceptance of the offer by the participant requires that the participant has filled in all required fields in the order form (each marked with an asterisk (*)) and has accepted these Terms and Conditions.

    • 6.2.3 The contract for participation in the event is only concluded after the organizer has confirmed the registration to the participants in writing via email. Amendments and/or additions to the contract must be in writing.

  • 6.3 Prices

    • 6.3.1 The price stated in the certificate of participation is the final price and is binding for the participant.

    • 6.3.2 All prices include applicable VAT, where applicable. If no discounts are listed, they cannot be granted.

  • 6.4 Payment

    • 6.4.1 Payment is made via the methods specified on the website. All prices are due immediately upon conclusion of the contract and no later than the day of the event.

    • 6.4.2 Payment by invoice: If the participant does not pay within 14 days of receiving the invoice, the organizer may withdraw from the contract. If the organizer withdraws from the contract, the participant forfeits their right to participate in the event. Any fees incurred through the bank transfer are the responsibility of the participant.

    • 6.4.3 Payment by credit card: When paying by credit card (MasterCard, Visa), the participant will be prompted to enter their credit card details during the payment process. The corresponding credit card account will then be charged the ticket amount.

    • 6.4.4 Should a payment be reversed (e.g., due to insufficient funds in the account specified during the order), the participant is liable for any damages or expenses incurred as a result of the reversal. This includes, in particular, bank fees and a processing fee of €10.00 per chargeback for handling by the organizer. In the event of an unjustified credit card chargeback, a processing fee of €40.00 will be charged. In the event of a chargeback, the organizer is entitled to withdraw from the contract immediately. The participant thereby loses their right to participate in the booked event. This does not affect any further claims the organizer may have against the participants.

  • 6.5 Right of Withdrawal
    Withdrawal is excluded according to §312g Paragraph 2 Sentence 1 No. 9 of the German Civil Code (BGB).

  • 6.6 Cancellation

    • 6.6.1 If the registered participant cannot attend the event, they have the option to nominate a substitute participant up to 24 hours before the start of the event or by email to info@chefswarehouse.de. Ticket transfers can also be made without prior notification of the organizer.

    • 6.6.2 The commercial trading or resale of tickets is not permitted.

  • 6.7 Services

    • 6.7.1 The scope of contractual services within the framework of the event is defined by the information materials, the details on the event website, any registration forms, and the organizer's confirmation of participation. In case of discrepancies, the service description in the booking confirmation shall prevail.

    • 6.7.2 If services are not provided in accordance with the contract, the participant is entitled to redress. Defects must be reported immediately. Claims for a refund of the participation fee due to services that are clearly not provided in accordance with the contract must be made within 14 days of the event's conclusion.

    • 6.7.3 The organizer reserves the right to appoint a substitute speaker in exceptional cases. Participants are not required to be informed of such changes.

    • 6.7.4 Travel, accommodation, and meals are not included in the event package unless these services are expressly listed in the event description. If a contracting party does not make full or partial use of services that have been properly offered, there is no entitlement to a refund of the participation fee.

  • 6.8 Cancellation of the Event

    • 6.8.1 The organizer may cancel the event for urgent reasons with reasonable notice. This also applies to social and evening programs.

    • 6.8.2 In the event of cancellation of the event, the organizer will refund the payment made in full within 14 days. Any additional costs incurred by the participant will not be refunded.

  • 6.9 Copyright and Other Rights

    • 6.9.1 The communicated event materials, such as banners, graphics, etc., are protected by copyright and may only be used for personal use. Rights of use and collaborations are only transferred through an express written grant of rights of use. Reproduction, distribution, processing, or public display of any kind is generally not permitted and requires the written consent of the organizer.

  • 6.10 Images/Photographs

    • 6.10.1 The participants of the event irrevocably and free of charge consent to the organizer's right to create, reproduce, transmit, or have transmitted image and/or sound recordings of their person that go beyond the mere reproduction of a current event, and to use them in audiovisual media.

 

7. House Rules

  • 7.1 The restaurant exercises its house rules.

  • 7.2 Guests who disrupt the restaurant, violate common decency, or behave inappropriately may be refused service or banned from the premises.

  • 7.3 Pets (dogs) are permitted by prior arrangement, provided they remain quiet and well-behaved throughout their stay. In cases of disruptive or disruptive behavior, the restaurant reserves the right to remove the owner and their dog from the premises. Owners are responsible for their dogs.

 

8. Liability

  • 8.1 The restaurant is not liable for clothing or personal belongings unless the loss was caused intentionally or through gross negligence by staff.

  • 8.2 The restaurant is not liable for damages caused by force majeure or third parties.

  • 8.3 In cases of simple negligence, the restaurant is only liable for breaches of essential contractual obligations and is limited to foreseeable damages.

 

9. Data Protection
The personal data of guests is processed in accordance with applicable data protection laws. For further information, please see our privacy policy on the website.

 

10. Final Provisions

  • 10.1 The laws of the Federal Republic of Germany shall apply.

  • 10.2 The place of jurisdiction is Hamburg, provided the guest is a merchant or a legal entity under public law.

  • 10.3 Should individual provisions of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provision.
